Terms of Use
1. Eligibility and Children's Guest Access
Cools Minigames provides registered account access for users who are at least 13 years old and a designated limited guest experience that may be used by children under 13.
Children under 13 may not create a registered account or use features that require them to submit an email address, phone number, or other information required for registered-account functionality. The children's guest experience may restrict features and may hide or anonymize user-created player names.
If you are under the age required in your jurisdiction to enter into these Terms on your own, your parent or legal guardian must review and agree to these Terms where required by law.
2. User Accounts
Registered users are responsible for providing accurate information, protecting their account credentials, and maintaining the security of their accounts. You may not access another person's account without authorization or permit another person to misuse your account.
We may require account, email, or phone verification and may use security measures intended to protect accounts and the Services.
3. Player Names and User-Provided Content
Where Cools Minigames permits you to choose a player name or provide other user-generated information, you are responsible for what you submit. You may not use content that is unlawful, abusive, threatening, harassing, obscene, hateful, fraudulent, infringing, impersonating, or otherwise inappropriate for the Services.
Critical Pixel may remove, hide, modify, anonymize, or restrict player names or other user-provided content when reasonably necessary to operate or protect the Services, enforce these Terms, comply with law, or protect users.
4. Guest Access
Guest access may provide fewer features than registered access. Guest sessions may use limited technical or session information necessary to provide requested functionality, maintain session continuity, secure the Services, and prevent abuse.
Guest access does not create a registered account and may not provide the same persistence, recovery, communications, purchases, or account features available to registered users.
5. Game Rules, Scores, and Leaderboards
Scores, times, rankings, achievements, and leaderboard positions may be recorded, validated, adjusted, removed, or reset when necessary to correct errors, maintain game integrity, address cheating or abuse, or operate the Services.
You may not manipulate scores, exploit bugs, use unauthorized automation, interfere with gameplay systems, or otherwise obtain an unfair advantage.
6. SMS and Mobile Messaging
Registered users may receive SMS messages that they request for account verification, phone verification, password recovery, or other account-security purposes.
Registered users may also separately opt in to optional score-beaten SMS notifications. Optional notification consent is not a condition of purchase. Message frequency varies and message and data rates may apply. Where supported, reply STOP to opt out and HELP for help.
SMS and mobile-messaging features are not available through the children's guest experience.
7. Purchases and Payments
Certain features or access may require payment. Prices, applicable taxes, and purchase terms will be presented before purchase. Payments may be processed by third-party payment providers, and their terms may also apply.
Purchases and paid registered-user features are not available through the children's guest experience unless Critical Pixel expressly provides such functionality in a manner permitted by applicable law.
8. Refunds
Refund eligibility may depend on the product, transaction, platform, payment provider, and applicable law. Unless otherwise stated at the time of purchase, requests may be reviewed on a case-by-case basis subject to applicable legal requirements and payment-provider rules.
9. Acceptable Use
You may not use the Services to violate law; infringe intellectual-property or privacy rights; harass or harm others; distribute malware; probe, scan, attack, or interfere with systems or networks; circumvent security or access controls; scrape or automate access in an unauthorized manner; manipulate game results; impersonate others; abuse messaging features; or attempt to disrupt the Services.
10. Suspension and Termination
Critical Pixel may suspend, restrict, or terminate access when reasonably necessary to protect the Services or users, investigate suspected violations, enforce these Terms, comply with legal obligations, or address fraud, abuse, cheating, security threats, or nonpayment.
You may stop using the Services at any time. Certain provisions of these Terms that by their nature should survive termination will continue to apply.
11. Intellectual Property
Cools Minigames, Critical Pixel branding, software, game content, graphics, interfaces, text, code, and other materials provided by Critical Pixel are owned by or licensed to Critical Pixel and are protected by applicable intellectual-property laws. Except as expressly permitted, you may not copy, modify, distribute, sell, license, reverse engineer, or create derivative works from protected portions of the Services.
12. Privacy and Children's Privacy
Our collection and use of personal information is described in our Privacy Policy, which is incorporated by reference where permitted by law.
Children under 13 may use only the designated limited children's guest experience and may not create registered accounts or use registered-user communication or SMS features.
13. Third-Party Services
The Services may interact with third-party websites, platforms, payment providers, communications providers, or other services. Critical Pixel does not control independent third-party services, and your use of them may be governed by separate terms and privacy policies.
14. Updates and Changes to the Services
Critical Pixel may add, remove, modify, rebalance, discontinue, or update features, games, content, systems, requirements, or functionality. We may deploy updates for security, compatibility, performance, legal compliance, or other operational reasons.
15. Service Availability
We do not guarantee that the Services will always be available, uninterrupted, error-free, or compatible with every device, browser, network, or platform. Maintenance, outages, technical problems, security events, or third-party dependencies may temporarily affect availability.
16. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.
17. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CRITICAL PIXEL AND ITS OWNERS, AFFILIATES, SERVICE PROVIDERS, AND REPRESENTATIVES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES ARISING FROM OR RELATING TO THE SERVICES.
Nothing in these Terms limits liability that cannot lawfully be limited or excluded.
18. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Critical Pixel and its owners, affiliates, representatives, and service providers from claims, liabilities, damages, losses, and reasonable costs arising from your unlawful use of the Services, your violation of these Terms, or your infringement of another person's rights.
19. Governing Law
These Terms are governed by the laws of [STATE / JURISDICTION], without regard to conflict-of-law principles, except where applicable consumer law requires otherwise.

20. Changes to These Terms

If any provision of these Terms is determined to be unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
22. Entire Agreement
These Terms, together with the Privacy Policy and any additional terms presented for a particular feature or transaction, constitute the agreement between you and Critical Pixel concerning the Services, except where applicable law provides otherwise.
